Terms of Service

1. ELIGIBILITY

You must be 13 years or older to use DM Dad.

By using the Services, you represent that you meet this requirement.

2. ACCOUNT REGISTRATION

To use DM Dad, you must create an account. You agree to:

• Provide accurate information
• Keep your login credentials secure
• Not share access with others
• Notify us immediately of unauthorized activity

We reserve the right to suspend or terminate accounts for violations of these Terms.

3. SUBSCRIPTIONS & BILLING

DM Dad offers paid subscription plans processed securely through Stripe.

3.1 Automatic Billing

By subscribing, you authorize Fantasma Dev LLC to automatically charge your payment method at each billing cycle until you cancel.

Billing cycles are clearly displayed at checkout.

3.2 No Refund Policy (Strict)

ALL PAYMENTS ARE FINAL AND NON-REFUNDABLE.

This includes, without limitation:

• Forgetting to cancel
• Not using the software
• Lack of activity
• Changing your mind
• Subscription renewals that were not manually canceled

By subscribing, you agree that charges continue until you cancel, and no refunds will be issued for any reason, except where required by law.

3.3 Cancellation

You may cancel your subscription at any time:

1. Log into your account
2. Visit your billing/subscription page
3. Click Cancel Subscription

Cancellation takes effect at the end of the current billing cycle.

You will still have access until that date.

4. LICENSE TO USE THE SERVICE

Fantasma Dev LLC grants you a limited, non-exclusive, non-transferable license to use DM Dad for personal or business use according to these Terms.

You agree not to:

• Reverse engineer, scrape, or modify the software
• Attempt to bypass security or usage restrictions
• Use the software for spam, abuse, harassment, or prohibited activity
• Sell or sublicense your account or access
• Use the service in a manner that risks platform bans for others

DM Dad may revoke access for violating these rules.

5. USER RESPONSIBILITIES

You agree to:

• Use the platform legally and ethically
• Comply with third-party platform rules (e.g., X/Twitter rules)
• Not use DM Dad to engage in harmful, abusive, or unlawful behavior

You are solely responsible for your actions when using DM Dad.

Fantasma Dev LLC is not responsible for bans, suspensions, or actions taken by third-party platforms due to your usage patterns.

6. PROHIBITED USES

You may not use DM Dad for:

• Illegal activity of any kind
• Fraud or impersonation
• Automated spam, mass harassment, or prohibited messaging
• Interfering with network integrity
• Attempting to scrape, clone, or copy internal systems
• Sharing or selling access to your account

Violation may result in immediate termination without refund.

7. INTELLECTUAL PROPERTY

All content, branding, software, code, design, and materials provided through the Services are owned by Fantasma Dev LLC.

You may not copy, reproduce, distribute, or create derivative works without express permission.

8. THIRD-PARTY SERVICES

DM Dad integrates with third-party platforms such as:

• Stripe (payments)
• Google (authentication/login)

You agree to follow the third-party's rules and acknowledge that we are not responsible for:

• Their availability
• Their policies
• Their actions
• Any account restrictions they impose on you

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

Fantasma Dev LLC is not liable for:

• Lost revenue, profits, or business
• Account bans or penalties on third-party platforms
• Data loss
• Service outages or downtime
• Indirect, incidental, or consequential damages

Your maximum remedy for any claim is limited to the amount you paid in the last 30 days.

Some jurisdictions may not allow such limitations; if so, the minimum required protections will apply.

10. DISCLAIMER OF WARRANTIES

The Services are provided "as is" and "as available."

We do not guarantee:

• That the Services will be uninterrupted or error-free
• That results will meet your expectations
• That third-party platforms will permit automated actions indefinitely

You use the Services at your own risk.

11. TERMINATION

We may suspend or terminate your account at any time for:

• Violations of these Terms
• Misuse of the platform
• Harm to system integrity
• Legal or regulatory requirements

No refunds will be issued upon termination.

12. GOVERNING LAW

These Terms are governed by the laws of the Commonwealth of Pennsylvania and the United States, without regard to conflict of law principles.

Any disputes shall be resolved exclusively in courts located in Pennsylvania, USA.

13. MODIFICATIONS TO THE TERMS

We may update these Terms from time to time.

We will post updated versions on this page with a new effective date.

Your continued use of the Services constitutes acceptance of the updated Terms.
